He regularly advises hospitals and health systems concerning nondiscrimination compliance and civil rights investigations brought by the Department of Justice and the HHS Office for Civil Rights. Section 1557 of the Patient Protection and Affordable Care Act (ACA) is entitled “Nondiscrimination” and prohibits discrimination based on race, color, national origin, disability, sex, and age in federally-funded health programs and activities. Like Title VI of the Civil Rights Act of 1964, Section 1557 prohibits discrimination based on national origin in federally-funded health care. “National origin discrimination” covers discrimination based on an individual’s place of origin, his or
her ancestor’s place of origin, or an individual’s manifestation of the physical, cultural, or linguistic characteristics of a national
origin group. This includes the language an individual does (or does not) speak.
